  1. What are my options as a member of the Class?

    If you are a member of the class, you have the following options:

    • Participate in the settlement – If you agree with the proposed settlement, you may elect to receive either a cash payment or a BMW Assist service benefit, as described in the Notice, by filing the claim form or Subscription Agreement Addendum, postmarked or online, by July 10, 2012.
    • Request Exclusion by July 10, 2012 – You will not be entitled to participate in the settlement if you choose this option.
    • Object or Comment by August 7, 2012 – Write to the Court about why you do, or do not, like the settlement. You must remain in the class to comment in support of or in opposition to the settlement.
    • Attend the Hearing on August 27, 2012 – Ask to speak to the Court about the fairness of the settlement.

  2. How do I file a Claim Form for payment from the Non-Reversionary Fund?

    To receive a cash payment, you must submit a Claim Form, postmarked to the Claims Administrator or submitted online, no later than July 10, 2012.

  3. How do I submit a Subscription Agreement Addendum?

    You may elect to receive an upgrade or extension to your BMW Assist™ service, as described in the chart reflected in the Class Notice. This upgrade or extension is valued at approximately $100, based on pricing currently in effect for BMW Assist™.

    No claim form is necessary to obtain the service benefit, but you must submit a BMW Assist™ Subscription Agreement Addendum during the Enrollment Period. A Subscription Agreement Addendum must be postmarked to the Claims Administrator, or submitted online, no later than July 10, 2012.
